VALIDE PRICE FOR 30 DAYS—Our submission is valid for a period of 30 days. Beyond this time, please contact us if you wish to see an additional 30 days or confirm these costs until a certain date.

ACOMPTES AND DÉPÔTS—For all contracts requiring us to order specific materials and/or rent and/or include specialized equipment (articulated pods, Straight pods, lift platforms, suspended pods, cranes or other equipment), you will have to pay us, upon confirmation of the order or no later than one (1) week before the start of work, a deposit or deposit covering all of these fees including applicable taxes.

SCOPE OF WORK – The scope of work is limited only to what is detailed and listed in the bid. You have a responsibility to ensure that the submission lists and includes all the work you want to do. Any omissions or work not described in the submission will be charged in addition.

ADDITIONAL COTS—Any additional work or request, not included in the bid, such as removing and relocating fences, shutters or other architectural elements, as well as adding and/or replacing non-apparent or non-visible sealing joints when visiting the premises for estimation purposes, will be charged in addition to the same rate (price per root foot for equivalent work) or at an hourly rate of $95/hour plus materials required depending on the nature of the work. An estimate of additional costs (amendment) will be provided immediately and will need to be approved by the client before the additional work is completed. This approval will have to be done on site at the time of the work. In the absence of clients in the workplace, this approval can be done by email, text message or fax. Special requests such as electrical work for the connection of lifting equipment are never included in the bid and are always charged in addition to an administration fee of 10%.

PERMITS and SIGNAGE (Mandatory when encroaching on public roads such as streets, alleys, sidewalks and municipal property) —All permit applications and signage fees required by the various municipalities, boards and different levels of government must be made before the start of the work, as soon as the order is confirmed. These fees are never included in the submission and are always charged in addition to an administration fee of 10%. To ensure that we are in good standing, Calfeutrage Élite takes care of these procedures on your behalf.

DATE OF TRAVAUX—When confirming your order, you must tell us how long you want the work to be done. Upon receipt of your order confirmation, we will contact you to agree on an approximate date. However, we will not be able to confirm a specific date because we are dependent on weather conditions. Our policy is to complete the work within 30 days of the order being confirmed. In most cases, the work is done within 15 business days of the order being confirmed. In order to compensate for delays caused by bad weather, we sometimes carry out the work on weekends (Saturday). If you accept this possibility, you will need to ensure that your neighbourhood does not like it and/or violates the municipal bylaws in your neighbourhood.

Accessibility TO THE TIME OF TRAVAUX—If it has been agreed that we will carry out the work during your absence, Please ensure that the windows will be closed and that all caulking sections will be free to access (unlocked fences, temporary carports and retired air conditioners, closed windows, etc.) and that there will be no obstacles (car, trailer or other vehicle in the garage entrance) that will prevent us from safely using ladders , pods or other equipment. JOINTS: The submission provides for the replacement of caulking joints with joints of the same colour as the original joints. We cannot guarantee that the color of the new seals will perfectly match the frames of your doors, windows and sidings of your building that will inevitably change color over time.

WHITE JOINTS AT POLYURÉTHANE—Polyurethane BLANCS joints can quickly change color, and there is no guarantee of replacement if this happens. You will have to fully assume this risk and relieve us of any responsibilities due to the color variations of the POLYurethane WHITE joints.

FOR reasons of sealing and aesthetics, the new joints are always wider than the previous ones to cover the traces and residues of old sealants that cannot be completely removed from the different materials or substrates. Industry practice suggests at least 5/8 to 3/4 inch-wide joints with an average depth of about 3/8 to 1/2 in the center. HEALTH AND SAFETY ON WORK FACTS—Any project must be carried out in full compliance with Quebec’s occupational health and safety laws. All necessary and mandatory fees to make workplaces safer, whether by Hydro-Québec or any other recognized organization, are never included in the quote and are additionally charged directly to the client. Applications to Hydro-Québec should be made by the customer as much as possible.

REWORK SATISFACTION—You must tell us, in writing, any dissatisfaction within 7 days of the work being completed. After this time, we will consider that you are fully satisfied with the work done. No deductions (fixed amount or percentage) can be made unless there is a written agreement beforehand. After the 7-day period, the total amount is due and the warranty will apply for the after-sales service. Any delay in payment of the work, any unauthorized withholding of payment or any outstanding account will immediately result in the suspension of your warranty until the final settlement. The warranty period is always depending on the date of completion of the work.

LANDSCAPING—If, for safety and accessibility reasons, we have no choice but to use our equipment on your property (earthwork, landscaping, sprinkler system and paving), rest assured that all precautions will be taken to avoid damage and breakage of any kind. However, for safety reasons, we have no choice but to encroach on certain elements with our equipment, additional fees will apply and you will be charged if we have to proceed with the repairs. It is the client’s responsibility to inform us before the submission stage of all the inherent risks (plan of the sprinkler system, plan of underground indoor parking lots larger than the exterior building, etc.).

THE soaking solution used to moisten the wooden strips used to shape joints can leave some marks on the frames and windows, especially when caulking the contours of the thermos. In fact, these traces appear especially when the solution dilutes the residue of dust accumulated over the years on the frames and on the windows. Unfortunately, these traces cannot be wiped during work without the risk of altering the finish of the new freshly applied joints. Traces should disappear after one or two direct rains or when you have the windows cleaned. Window washing, as a result of caulking work, is not part of the caulking process and is never included. It is your responsibility to plan this task with a specialized company a few weeks after the work is completed. We cannot guarantee the total disappearance of traces on the frames.

THE majoritY of waste will be collected at the end of each shift. If possible, we will avoid throwing the old sealant on the ground, but rest assured that any residue that falls will be collected as regularly as possible. A final check of the premises will be done before we leave the premises for good. In some cases, we have no choice but to encroach on certain landscape elements. We always strive to put the place back as it was before the work began. Despite all our precautions, if landscaping repair work is necessary, it will be paid by the customer and invoiced in addition unless the customer wishes to take care of it himself.

OPTIONS – The choice of OPTIONS must be made before the day of the work so that we can have enough time to order the quantity of materials needed to carry out the work and plan for the costs and rental of additional equipment.

PREPARATION AND CLEARING OF THE SITE BEFORE AND DURING THE WORK – The client must ensure, before the start of the work, that the site is properly accessible and has a clear clearance of at least one metre (3 feet) to allow employees direct access to the elements to be caulked. The client has the responsibility to move and protect his own belongings (patio furniture, BarBQ, plants, etc.) on balconies, terraces and other spaces with items to caulk. The customer will be required to authorize Elite Caulking to move goods that have not been moved properly and will relieve Elite caulking of any responsibilities in the event of a break or incident. We recommend that the customer remove or protect anything that may be damaged, such as mosquito nets, awnings, etc. Elite caulking cannot be held responsible for the repair or replacement of mosquito nets, awnings and any other items that have not been removed or protected by the customer before and during construction.

WORK NOT COMPLETED – If, in order to accommodate the client, it has been agreed that a portion of the work will be completed later (e.g., inaccessible items, abundant vegetation, failure to clear the premises, casement windows left open, air conditioners, etc.), we reserve the right to invoice the total portion of the completed work and to demand immediate payment. The balance of work will be completed and billed in time. No withholding of payment on any part or all of the work carried out will be allowed unless an agreement is reached beforehand.

PAYMENT OF WORK — NO DEDUCTIONS AUTHORIZED at the end of the work unless an agreement is signed in advance before the start of the work — The client (individual(s), owner(s), syndicate of co-owners, corporation(s), etc.) and the official signatory (letter of mandate or resolution in support) are jointly and severally liable for the payment of the invoice upon completion of the work. The work is payable in full in a single payment as soon as it is completed, unless the work is spread over more than one week. Withholdings of payment are non-applicable and unauthorized. Our guarantee applies in the event of justified dissatisfaction. The costs of renting, installing, moving and delivering scaffolding equipment must be paid at the signing of the contract or no later than 1 week before the start of the work. Caulking services or the balance of costs will be invoiced in weekly instalments if the work is spread over more than one week, and must be paid within 7 days of the end of the period (Example: If the work is spread over 4 weeks, the balance of total costs will be divided into 4 equal invoices (except that the first invoice will additionally include all applicable taxes) and will be payable at the end of each weeks). Interest charges on any late payment are 1-1/2% per month or 18% per year, effective the 8th day after the invoice date. The work can be paid directly on site to the team leader at the end of the work. Payment can be made by cash, cheque, direct payment (Interac), VISA or MasterCard credit cards. Credit card payments can also be made by phone by sending your contact information to our accounts payable manager at 514-910-3548 or by filling out the relevant portion at the bottom of your invoice and returning a scanned copy (PDF) to us via email (at: info@calfeutrage-elite.com) or by fax at 450-473-8778. Calfeutrage Élite reserves the right to register a legal hypothec with the owners of the building(s) undergoing work and will notify the intermediary if necessary. Any delay in payment for work, unauthorized withholding, or overdue accounts will immediately result in the suspension of your warranty until final settlement. The warranty period is always based on the date of completion of the work.

LIMITED WARRANTY—Upon completion of the work, our limited warranty (10 years – single-family RESIDENTIAL sector including condominium buildings of 4 storeys or less and a maximum of 12 units) (5 years – for all other sectors (COMMERCIAL, INDUSTRIAL and INSTITUTIONAL) including multi-unit dwellings, condominium towers and all buildings with 5 storeys or more) only covers you against joint detachment due to poor adhesion during application new seals. The warranty only covers seals replaced by Elite Caulking (detailed submission and invoice to support). This limited warranty only covers the replacement of defective seal sections with new sealing joints of the same type and/or equivalent. For all used buildings, without exception, there is no guarantee against water infiltration. The warranty period is always depending on the date of completion of the work and begins on that date. In all cases, the guarantee is limited to the maximum value of the caulking contract only excluding all other costs (equipment, permit and signage). In all cases, the customer will pay the cost of renting and using the equipment (pods, scaffolding, cranes, etc.) as well as permits and signage costs in order to correct the situation.

LIMITATION OF THE GARANTIA—Elite calfing cannot be held responsible or liable for any loss of income, profit, other direct, indirect, secondary or accidental damage due to a defect in the products used or a delay in the delivery of the products used due to circumstances beyond our control. Cancellation times for specialty equipment reservations and special colour sealant orders are 15 days before the scheduled work date Fees may apply if these deadlines are not met.
